Viable and DeafNation Expo cheated deaf community with "junk" VPADs last year

If you think Viable can run away from the FBI investigation and play innoncent, that's not going to happen. They will fall into a trap of new findings very soon.

...Many, many deaf customers were not happy with their defective VPADs?

I have been an employee at Viable for three years. Because of my confidentiality contract with Viable, I couldn’t discuss issues with anyone other than Viable staff. I am very disgusted at both Viable, Inc. and DeafNation, Inc. for misleading and cheating deaf buyers last year. I prefer to release this post and remain anonymous from any possible lawsuits until the process of Class Action against Viable and DeafNation is done.

Viable VPAD is a 10.2-inch touch screen, an USB port, audio/visual ports, and allows for one-click connection to ViableVRS. The VPAD is the first WiFi-enabled and portable videophone to be developed for VRS users. See VPAD demo - http://www.viable.net/product/vpad.

John Yeh was fully aware that the all VPADs were already flawed and defective before they were sold at DeafNation Expo last year. The touch screen was not correctly functioned.

When a new, upgraded device VPAD+ (VPAD Plus) successfully functioned, John Yeh had no money to manufacture VPAD+. He was worried and had to fire some of his employees and figure out with many, many “junk” VPADs in stock.

In late December 2007 Viable Founder John Yeh and two Viable executives urgently invited DeafNation co-founders Joel Barish and Jed Barish to the confidential meeting near the 2008 International Consumer Electronics Show in Las Vegas, in January of 2008.

After hours of private deliberation in John Yeh's hotel suite room, John Yeh couldn’t say no to Joel Barish’s dreadful offer to sell "Junk" VPADs at DeafNation Expo in April and May of 2008.
DeafNation intentionally contracted an undisclosed arrangement with Viable, Inc. to get rid of all "junk" VPADs at DeafNation Expo in April and May of 2008, to mention hidden charges at DeafNation Expo and to earn big commission per VPAD sold.

DeafNation intentionally agreed with Viable, Inc. to put "Buy VPAD for $99 at Deaf Nation Expo! If you're not happy with it, we'll give you a full refund" advertisement on DeafNation Expo's website and to take it down after 30 days.

Viable intentionally agreed to change their refund policy after VPADs were purchased.

Thousand “junk” VPADs were sold out at DeafNation Expo: Pomona, California, on April 12, Omaha, Nebraska., on April 19; Columbus, Ohio, on April 26; and Atlanta on May 3.

That was only 22 days...That was LESS than a month!

DeafNation Expo took down the "Buy VPAD for $99 at Deaf Nation Expo! If you're not happy with it, we'll give you a full refund" advertisement from the website and advised all customers that VPAD were sold and non-refundable.

Many, many victims grew anger and lost a lot of money on VPADs. Not many of them can afford to hire an attorney to handle this fraud case. It’s very sad that several “dirty” VRS companies and DeafNation Expo made millions of dollars out of the deaf community.

Viable thanked DeafNation for all the dirty efforts and wrote them checks in the amount of $425,000 for commission.

Last June I bumped Joel Barish at Puerto Rico DeafNation Expo. He chuckled and winked. My emotion crumbled into widespread disgust.

    That person said that FBI has fined Viable, Inc for 33 million dollars.

    This is why they are able going on with business.

    It doesnt mean that they are winning.

    FCC has a plan to decrease minute rate down to 4 dollars per minute from current rate which is 6 dollars. It will happen very soon.

    They will remain in HEAVY debt for years and years.

    It will eliminate Viable and SnapVRS because they are crumbling already.

    It will reduce 50% or more of VRS business in USA. That way, taxpayer's money would pour into new armored vehicle to be sent to Afghanistan, new school, new hospital, and etc. Why do we need more VRS business? Damn them to hell.

  5. I need send to return my VPAD not important. My VPAD seemed not success work on it wifi in and out of wireless. I heard some gossip about viable troubler to happen from FBI. The FBI found evidience some thing wrong reason against to Viable Inc. I want Viable give me full the refunded. Anyway The viable inc think to need give me full money $99.00 by themself. If They need ask me about VPAD return. then I will be fine to send them my VPAD return. I do not need used the VPAD. Please Response me immedately. If not then I will ask to FBI anytime.

    Good luck doing that. As a former Viable employee, I think you are better off recycling your VPAD with your local electrical recycling facility or an electrical engineering student would be interested in opening it up and tamper with it. Don't bother calling the FBI. They probably won't understand a word you're saying and ignore you. Don't waste your time trying to figure out what to do with the VPAD. It's not worth it.

  14. Relay providers depend on the National Exchange Carriers Association (NECA) to administer the Telephone Relay Service (TRS) fund. By order (or on its own) the NECA withheld funding for CACVRS which in return could not reimburse all of its affiliates including Viable. My theory is with and without ICSD and Mascom Viable still screwed around and CAC get burned unless CAC was also screwing around for their own reasons.

  15. Also Purple is up the shit creek without a paddle. Last week, the FCC issued an order to their Request Petition saying that relay calls involving NO HEARING PERSONS are not compensable.

    Now, you may wonder... why would there be relay calls with no hearing people? What the fuck is that, you may think? Is that even possible?

    Yes, it is possible, and this is known as the daily independent contractor meetings. I've been on a lot of them and they are a joke. How it is set up is that each deaf person or 'independent contractor' would call into a toll-free conference number using their VPs, so each 'independent' contractor has their own VRS agent.

    This is very profitable for companies like Purple. The meetings go on for more than two hours every day, and Norman Chan and Sam Costner would follow a script, and the first thing on it says to talk about anything for 10 minutes or so... to waste time. And, basically they repeat the same shit every day, asking us to talk about football or whatever the fuck went on that day...

    Suppose that there are 30 independent contractors on a call, that means Purple would get approximately 195 dollars a minute! (30 callers times $6.50 a minute).

    As it is for two hours or longer, Purple gets 11,700 dollars per hour! All in a day's work, huh?

    Anyway, the FCC put a stop to this practice last week (actually they said it was always illegal and even rapped them for being inconsistent with what they file with the FCC...)

    Belby Krick, how is the daily calls protecting our rights? Or is it protecting your wallet???????

    In a few days ago, I have talked with one of Yeh's closet friends and he said that SnapVRS is not in 100% possession of Viable yet. It's entirely up to Tom to make a final decision, eventually. He said that the chance for SnapVRS to acquire Viable is slim.

  32. Snap will not acquire Viable. Snap is not interested in Viable. They only want the VPAD and the softphone Viable was planning. Viable is dead. In fact, the few remaining Viable interpreters have just gotten SnapVRS training. They are now Snap interpreters.

    It is true that Snap is not 100% in possession of Viable. Snap has a 1 year option to purchase. Right now Viable is still independent. John Yeh is the sole director of Viable's corporate entities.

  34. Long story short, the company I worked at turned out to be run by really sleazy people and they couldn't make payroll. 3/4 of the staff quit after not being paid for a month. The company went bankrupt.

    I definitely will not come to Viable, Inc's open house.

    -Had to lay off more people- virtually no cash flow.

    -Snap! will NOT give Viable any more loan.

    -Snap! hopes that FCC/NECA will approve the billing by the 22nd of October. If not, then RIP Viable.

  39. If what I heard at the meeting is right, Viable would merely be folded into Snap to form a hypothetical "new company". However, with a want to repossess unused VPAD(+) rather than to produce new ones, it makes me wonder how much is really left in the Viable tank.

    As for yesterday's layoffs, it was a lot of staff that were not the rising stars of the company (one of them missed a month of work since August) and frankly it was getting rid of some people who were unprofessional. Might be a plus in the long run.

    Actually, I searched the court documents and found Mary Moylan's first trial on 10/19 was dismissed. If you look at it there's a remark that says "other plea" Looks like they paid her and settled out of court to avoid facing a jury.

  74. Viable fellows certainly didn't read Tom Clancy that much. FBI ought have had planted some bugs in their PCs, databases, hardware, and software after they were confiscated by FBI. Whenever Viable's server has connected to Snapvrs, and then their server, database, pc, and many more to be infected by FBI's invisible spyware that cannot be detected by Viable and SnapVRS' very own senior programmers. FBI has done this job for more than 5 decades.

    Speaking of adversity, we Yehs do not know much about that. We are all doing just fine, thank you. Even though it was our doing, our mismanagement of the company, and our greed and fraudulent behavior that caused all these problems, we are still doing OK. We socked away Viable's money over the last several years instead of building a cushion. You see, we never expected Viable to stay viable. It is all about us making money as fast as possible.   86. I absolutely love the email. Says it all right there in a nutshell. I still have many friends working there, and I am so sorry to see them stay but I understand they are trying to pay bills too. The interpreter market in the east is so flooded right now from VRS terps it's a shame. To those still working or not, please don't listen to all the junk written in this blog. Remember your job and why you chose it. The harsh opinions expressed here by a few are not the opinions of the deaf community as a whole. You know why you got into this business and you keep that in the front of your mind. Look at how far the deaf community has come over the last few decades...more communication, more equality, more self-advocacy. Sure it has a long way to go, but it has to start somewhere.

    I wish all of you the best of luck, from the current employees, to the terps who were laid off or quit, and the deaf employees who gave their all as well. The installers working late into the evening, helping to make sure the customer understood...the terps who loved what they did and what it stood for...helping people communicate. It was good when it was done right. Sadly, greed makes people do horrific things and the outcome is so many families and an entire community hurt and choosing sides. Please try to be understanding here and see both sides and opinions. No need to bash people on here. Please, think before you get all upset.

    What can I share? The investigation on this case hasn't ended, yet. It is only beginning. The number of arrests that have been numbered on the Department of Justice is only initial update on ongoing investigating.

    There are some crooks that haven't arrested or didn't catch them on time since FBI certainly cannot arrest ALL wanted crooks across the nation, simultaneously. I know they have tried their best to meet an immediate release document's deadline.

  107. Let me share the story about Larry Berke.

    He owns the deaf apartment located just adjacent to Gallaudet University campus.

    The number of building is 625 on Florida Ave, NE.

    The number of room at #402 was where Dary Berke, Lawrence Berke, and Jason Yeh lived. IF you go behind that building and you will notice the long blue cable for the high speed connection is still hanging there after Berke and Yeh moved out of that building. They acted like ITs to put the cables thur the vents and stuff like that.

    Jason and Lawrence worked together to start up the VRS business since they are both fluent programmers.

    In a year later, Dary moved in that room.

    I knew Berke and Yeh very well. They were my personal friends.

    Larry Berke is a professional slumlord at this date.

    He had more than 14 VP 200 devices mounted on his TV and multiple IP address to perform a "run calls". His son, Dary Berke worked alongside with him.

    Lawrence Berke apparently has fled from this country. He has been out of this great country for more than a year now. It certainly appears that He knew that his father will be arrested.

    Lawrence Berke helped his father to start up the VRS business and later joined Viable, Inc as a senior programmer. The most humble guy that I know. It is amazing that he hasn't been arrested yet. It must be the reason that he is still out of USA.

    Larry Berke had been secretly working with John Yeh when Yeh started his business and later, they both feud because John Yeh didn't regularly pay him on all false minutes that Larry made for John. It all happened in between 2006 to 2008. Therefore, he humbly started his own company which is called KL Communications LCC.

    I have heard a numerous of stories of residents who are living at the deaf apartment. Larry Berke mistreated them just like Yeh mistreated his own fellows.

    I say, Larry Berke, FUCK YOU.

    Viable, Inc has been targeted because they think that their wrongdoing cannot be caught because Yeh KNEW that other VRS industries have done the same thing. Yeh has been wondering why those industries haven't caught yet. Therefore, Yeh made their own vivid move that comes with transparent secret plan.

    In a few days after raid made at Viable,Inc's HQ. John Yeh said that his company is fine, and FBI was just misunderstood because there are also fraud generators at different company. He has pointed at them (someone witnessed him pointed at Purple, and others companies), already. FBI secured those information from John Yeh, directly.

    This is why John Yeh said that he has fully cooperated with FBI and then FBI & FCC went silence for months.

    Yeh supposed that he is fine and safe because he has cooperated with them.

    Those programmers are not all deaf. Some of them are hearing programmers.

    Some of them were my personal friends.

    They are way cooler than Yeh.

    Please don't think badly of them. Those programmers are innocent except two senior programmers which are Jason Yeh and Lawrence Berke.

    Yeh and Berke took advantage of them. They usually stealing their own team's credit for their hard works.

  118. "Charged" is proof enough. They have been arrested but didn't go to jail. They went in and out. They have been summoned to go to federal court. They are still innocent at this moment until justice discovers them guilty. Also, arrest doesn't require the handcuff but escorted with FBI to the court. Simple as that. Right now, 26 of them are getting their own lawyers and building a strategy to defend themselves. Also, Department of Justice has released the document, and FCC website too. "He who has no sin may cast the first stone"- before we start accusing each other, keep in mind that a majority of the VRS companies, including Purple, have been guilty of trying to take advantage of the NECA rates through "creative manufacturing of minutes". The last word regarding Purple's practices is that they fabricated conference calls with 20-25 Purple reps when there were no hearing people on the VRS calls. Imagine how much money Purple made through this devious practice? Also, anyone familiar with Datastar? This is another attempt by Purple to manufacture minutes through the hiring of Deaf telemarketing reps to make questionable telemarketing calls through VRS.

    I am sure that this is only the beginning, unfortunately for us Deaf folk, this is going to hurt us more than help us.

    The court (federal) date will begin in Dec 2009, no specific date yet.

    He said that some of them will change the side to against Yeh in order to get reduce sentence for part of this scheme.

    Sad, I bet that a lot of them will point at John Yeh. It is part of FBI' game.

  140. I learn that Deaf Studio 29 owners excused from jailed which they listed the bottom of the details which they were arrested. They got home last Sunday. Marc, Ellen and Doris are bad in the past that I know. They are not involved with Viable. They did marketing with a different VRS industry. They encourged the Deaf callers to call the podcast, radio talk and conference meetings. Deaf callers were working so hard for Marc. They were supposed to earn money from him. However, he never pay to them...they felt so wasteful on working hard by sitting on many hours. They want to sue them in court anytime. Marc, Ellen and Doris earned plenty of money from the provider and bought a fancy house in Oregon for themselves - not giving the Deaf people which Marc owe to so many. Deaf callers are still angry to him. Marc ignored all Deaf callers. In fact, he is greedy - not giving them monies they need.

    Times that by a few interpreters by 24 hours in a day and that equals RED.

    Viable' original lawyer resigned just a few weeks after raid.

Nice, This morning, Viable and John Yeh and officers showed up for the first hearing from the lawsuit and scheduled a summary judgment hearing for January 2010, BUT interesting enough, they didn't show up for the 2nd hearing with a group of class action suit scheduled for 9:30am. Judge said 'defendants failed to appear'. Interesting...show up for one and skip the other. LOL!

    I feel sorry for the remaining employees as they've gone from working for one man with too much pride to give up to a man who just refuses to see the writing on the wall. What does Snap know that we don't that somehow makes Viable worth keeping? The bind the FBI put them in regarding paying Viable's employees is just an invite for another class action lawsuit.

  165. Last night Anthony Mowl and his sister being discussing was seen at DHHP in DC. His sister was a bit upset and frustated by Anthony Mowl's sly talkness.He implied at his guy freind to stay with him!Anthony Mowl looked so cool as he was drunk and as if he believed that he would walk away somehow.He played with word at her,and he tried to convince her to believe that he was approriately innocent. He was weird ! He will definitely be imprisoned for a long time..The lawyer for Department of Justice told CNN that all 26 people will be in jail no matter what ! their defense lawyers knew that Department of Justice will procecute them for sure! Bad news for Mowl. Procecutor for Department of Justice won 98 percent of criminal cases. Better take plea bargain to have the least time of imprisonment or maximum term if he goes to the trial.

    Yeh knew that he is marked for fraud and currently on blacklist. Even, President of NAD went there and saw Yeh around. President of NAD made a comment on his wrongdoing. Lots of good people went there knew what Yeh did and yet John Yeh is smiling around. He is indeed begging for a mercy.

  168. Perhaps the Yehs/Mowl purchased their tickets to this gala before the indictments. Gallaudet could have cancelled their tickets though, as rude as that might be it'd be appropriate for a pariah in the deaf community.

    Why they would show their faces in public when their former employees have gone a month without pay at the holidays is just plain crass. They left such a mess and might take another company down with it unless Snap finds some way to lay everyone off and make them reapply to Snap. After all of this, who would want to work for Snap?

  176. My Dad used to wrok at Viable untill the FBI came in for the first time asking questions about a fraud that might be occuring within the company. He started looking for a new job as soon as they stopped paying us.... These actions did not only cheat the buyers of fraud products but the families who had people working for this company. This company is to help deaf people and yet according tomy Dad in late they laid off ALL of their deaf employees and now the company is down to about five engineers and all of them have perfect health......

  177. I'm impressed and dumbfounded that Viable's remaining employees have not staged some sort of protest at their lack of pay thanks to the FBI screwing Snap from paying them. I know it's a poor job market, but would a diverse or hearing workplace take the abuse Viable employees have taken without some sort of backlash? It's like the deaf employees are puppets who don't want to say no.

    If anyone at any other workplace was unpaid for a month on two separate occasions, wouldn't there have been some public grilling of Snap execs (or even the FBI since this latest thing is their faul) or some public backlash at the Yehs already?

  182. Not so true. The damages that John caused was under his administration. If John and his people have predicated that their business won't go well and they are supposed to file a bankruptcy BEFORE he unable to pay the wages.

    He had to rubbishing his very own people, instead.

    Basically, it contributes to his list of criminals with a potential long term in prison.

    This case will be likely to be added to federal court during the exhibitions.

    The truth is what he and his brother did was shameful. He is a blight on the deaf community, an unworthy role model, a poor businessman, and an embarrassment to the VRS world. Of course he is not the only one. There are other very well known companies that did what Viable did. But even so, to celebrate a fraud who deliberately hurt so many deaf people is wrong.

    Viable's leaders screwed friends, family, community, and more. If you still support this company and the people who led it, you should be ashamed.

  195. John T.C. Yeh, president of Rockville deaf-services company Viable, along with three other company executives, pleaded not guilty Monday in a New Jersey federal court to charges that include conspiracy to defraud the government.

    A jury trial is scheduled for Feb. 22, with pretrial motions due Jan. 11, according to court documents. A motion hearing is slated for Feb. 8.

    In mid-November, federal authorities charged the Viable executives and leaders of six other companies nationwide in a six-count indictment. Charges include conspiracy to defraud the federal government out of tens of millions of dollars, submitting false claims and mail fraud.

    The executives fraudulently billed the Federal Communications Commission about $390 an hour to interpret calls between deaf and hearing people, federal prosecutors said. The calls, generally referred to as "r calls," "rest calls" or "run calls," were illegitimate calls often made by friends or relatives that would be billed to the FCC's video relay service fund, officials said.
